Our solutions are tailored to the regulatory requirements in Switzerland - in particular the obligations under FINMA. This requires the complete recording and secure archiving of financial communications, as well as the protection of sensitive data through encryption and access controls.

The revised Data Protection Act (“FADP”) protects the privacy and fundamental rights of individuals whose data is processed. It requires that personal data be processed lawfully, proportionately, and transparently (Art. 6 revFADP). A distinction is made between ordinary personal data and particularly sensitive personal data. The law obliges data processing organizations to clearly inform data subjects about the purpose, scope and duration of data processing (Art. 19 ff. revFADP) and grants them extensive rights, such as information, correction and deletion.
The Financial Services Act (FinSA) obliges financial service providers to document client advice comprehensively - including recommended products, their motivations and individual client needs (Art. 8 FinSA). Customers must be informed transparently, comprehensibly and fully about the risks, costs and characteristics of financial products before concluding a contract (Art. 7 FinSA). Furthermore, the law contains requirements for the creation of standardized information sheets and creates a uniform framework for the protection of investors.
The Financial Institutions Act (FinIA) regulates the authorization and supervision of various financial institutions such as asset managers, trustees and securities firms. It obliges them to have an appropriate organization with effective risk management, an independent compliance function and clearly documented internal guidelines (Art. 24 ff. FinIA). In the event of serious incidents, data protection breaches or system failures, there is an immediate reporting obligation to FINMA.
The law is supplemented by the Financial Institutions Ordinance (FMIO), which specifies technical details such as corporate governance, internal control systems, encryption standards, geographically distributed data backups and disaster recovery concepts (FMIO, in particular for the implementation of Art. 24 ff. FinIA). It ensures that both investor protection and market stability are guaranteed.
